Morris v. CMS Oil & Gas Company, 2010 WY 37, 227 P.3d 325 Wyo. 2010). (Helped to define the limits of the Wyoming Royalty Payment Act. The case specifically addressed the $100.00 penalty set forth in Wyoming Statute §30-5-303 and how attorney fees are to be calculated and awarded to royalty owners.)

City of Gillette v. Hladky Construction, Inc., 2008 WY 134, 196 P.3d 184 (Wyo. 2008). (Establishing the tort of "breach of good faith and fair dealing" in regard to construction contracts - affirming jury verdict for $1.7 million in favor of the contractor.)

Unreported Cases


DM&E Railroad v. Bridle bit Ranch, Co. et al., Campbell, Converse, and Niobrara Counties, Sixth, Seventh, and Eighth Districts, Wyoming. The firm represented various landowners in a complex condemnation action brought by the DM&E Railroad to obtain lands for the construction of an interstate railroad system.

State of Wyoming v. Twenty Mile Land Company, Civil Action No. 26015, Sixth Judicial District, Campbell County, Wyoming. This case involved the successful defense by a landowner of its right to restrict access by the Wyoming Department of Environmental Quality (DEQ) to its real property.

In re Wellstar Corporation, Department of Revenue, Docket No. 2002-51. The successful defense of a sales tax claim brought by the Board of Equalization. The State sought a recovery of sales tax for the injection of coal bed methane water back into a water injection well.

Rawhide Resources, LP, et al v. Kennedy, et al., Civil Action No. 19882, Sixth Judicial District, Campbell County, Wyoming.
A successful claim was brought by the Plaintiff seeking the recovery of royalties, payment of interest and penalties, and determining ownership in an oil and gas well.

IKON Office Solutions, Inc. v. Knapp, et al., Civil Action No. 02-CV-052J, United States District Court, District of Wyoming. Defense of a breach of a non-compete agreement.

State of Wyoming v. MFS, Confidential Civil File, Sixth Judicial District, Campbell County, Wyoming. This case involved the defense of a fifteen (15) year old child charged with two counts of first degree murder, conspiracy to commit first degree murder, and accessory after the fact to these murders.

Morgan v. Ellifrizt & Getter Trucking, Civil Action No. 14427, Sixth Judicial District, Campbell County, Wyoming. This was a wrongful death case resulting in the then largest settlement of a civil action in Wyoming (1984).
